These Terms of Use ("Terms") govern your use of Noah's Ark: Endless Voyage ("the Game"), developed and published by LilPuma Games ("we", "our", or "us").
By downloading, installing or using the Game, you agree to these Terms.
If you do not agree with these Terms, please do not use the Game.
These Terms should be read together with our Privacy Policy.
Nothing in these Terms affects any rights you may have under applicable consumer law.

Noah's Ark: Endless Voyage is designed to be suitable for a mixed audience, including children, teenagers and adults.
The Game may ask users to select an age range for advertising and privacy purposes.
The available age ranges are:
12 or younger
13–15
16–17
18 or older
This age selection is used to apply appropriate privacy and advertising treatment.
It does not unlock different gameplay, rewards or content.
If you are a parent or guardian, you are responsible for deciding whether the Game is appropriate for a child in your care and for supervising their use of the Game where appropriate.
LilPuma Games grants you a limited, personal, non-exclusive, non-transferable and revocable licence to download and use Noah's Ark: Endless Voyage for personal, non-commercial entertainment purposes.
You may not:
copy, reproduce or redistribute the Game except where permitted by law;
sell, rent, lease or commercially exploit the Game;
modify or create unauthorised derivative versions of the Game;
reverse engineer, decompile or attempt to extract source code except where such restrictions are prohibited by applicable law;
bypass or interfere with security, purchase, advertising or gameplay systems;
use cheats, automation, exploits or unauthorised tools to manipulate the Game;
use the Game in a way that is unlawful, fraudulent or harmful.
All rights not expressly granted to you remain with LilPuma Games.
The Game currently includes features such as:
Endless arcade gameplay
Local leaderboards
Animal collection
Ark colour collection
Daily rewards
Continue Tokens
Training Mode
Optional rewarded advertisements
A one-time banner advertisement removal purchase
Planned global leaderboard functionality, currently displayed as "Coming Soon"
Global online leaderboards are not currently active.
Features may be changed, expanded, temporarily unavailable or removed as the Game continues to develop.
LilPuma Games does not guarantee that every feature will remain available permanently.
Gameplay progress is primarily stored locally on your device.
This may include:
Local leaderboard scores
Best scores
Unlocked animals
Unlocked ark colours
Daily reward progress
Continue Token balances
Game settings
Age-range selection
Other locally stored gameplay preferences
LilPuma Games does not operate a player account system or online gameplay database for this locally stored progress.
Uninstalling the Game, clearing app data, changing devices or other device-related events may result in locally stored progress being lost.
You are responsible for maintaining access to your device and its locally stored data.
Training Mode is intended to allow players to practise gameplay.
Where the Game indicates that progression is disabled during Training Mode, scores or progress earned there may not:
unlock animals;
unlock ark colours;
count towards permanent progression; or
count towards future online competitive features.
The exact behaviour of Training Mode may change as the Game is updated.
Noah's Ark: Endless Voyage contains advertising provided through third-party advertising services, including Google AdMob.
The Game may contain:
banner advertisements; and
optional rewarded advertisements.
Rewarded advertisements may allow a player to receive a gameplay benefit, such as continuing after a crash.
Watching a rewarded advertisement is optional.
If you do not want to watch a rewarded advertisement, you can continue using the Game normally and begin another voyage.
Advertising availability is not guaranteed and may vary depending on:
location;
privacy choices;
age-related advertising treatment;
internet availability;
advertiser demand;
Google services; and
other technical factors outside LilPuma Games' control.
LilPuma Games does not guarantee that a rewarded advertisement will always be available.
The Game restricts advertising to a maximum content rating of G and applies different privacy and advertising treatment depending on the user's selected age range.

Noah's Ark: Endless Voyage may offer optional in-app purchases.
The current Game includes a one-time purchase that removes banner advertisements.
On Android, purchases are processed through Google Play Billing.
LilPuma Games does not directly process your payment card or banking details.
Payment processing is handled by the relevant platform provider.
Purchasing the Remove Ads entitlement removes banner advertisements from the Game.
It does not remove optional rewarded advertisements used for gameplay features such as continuing after a crash.
Rewarded advertisements remain optional and are only initiated when the player chooses to use the relevant feature.
The Game may check the relevant platform store to determine whether an eligible purchase has previously been made.
Where supported, this allows an existing entitlement to be restored.
Purchases and refunds are subject to the rules, terms and refund policies of the platform through which the purchase was made.
LilPuma Games may assist with purchase-related questions where reasonably possible, but the platform provider may control whether a refund can be issued.
Nothing in this section affects any statutory rights you may have under applicable consumer law.
The Game contains configuration relating to third-party gaming services, including Google Play Games.
Global online leaderboard functionality is not currently active.

Players are not currently required to use an online leaderboard or third-party gaming profile in order to play Noah's Ark: Endless Voyage.
If global online leaderboards are introduced in a future version:
additional third-party platform terms may apply;
leaderboard functionality may require a supported platform account;
gameplay scores may be submitted to the relevant platform service;
LilPuma Games may introduce reasonable anti-cheat or score-validation measures; and
our Privacy Policy and relevant store disclosures will be reviewed and updated where necessary.
LilPuma Games does not guarantee that planned features will be released on a particular date.
You must not intentionally interfere with the normal operation of the Game.
This includes attempting to:
manipulate local or future online leaderboard scores;
falsify gameplay progress;
obtain purchases without legitimate payment;
obtain rewards through unauthorised methods;
modify the Game to gain an unfair advantage;
use bots, scripts, automation or cheats;
exploit bugs or vulnerabilities to manipulate gameplay or rewards;
interfere with advertising, billing or platform services.
Where online competitive features are introduced in future, LilPuma Games may take reasonable steps to remove or disregard illegitimate scores where technically possible.
We may also take reasonable measures to protect the Game from abuse, fraud or technical exploitation.
The Game may use services provided by third parties, including services associated with:
Google Play
Google Play Billing
Google AdMob
Google User Messaging Platform
Google Play Games
Google Play services
These services are operated independently by their respective providers.
Their own terms, policies and privacy practices may apply to your use of those services.
LilPuma Games is not responsible for the operation, availability or independent policies of third-party services.
Some features may require an internet connection.
You are responsible for:
your internet connection;
mobile data charges;
device compatibility;
maintaining sufficient device storage;
keeping your device and operating system reasonably up to date.
The Game may not work correctly on every device or operating system version.
LilPuma Games cannot guarantee compatibility with unsupported, modified, rooted or otherwise altered devices.
Noah's Ark: Endless Voyage, including its original:
game design;
artwork;
characters;
logos;
branding;
user interface;
animations;
sounds;
text;
software;
gameplay systems; and
other original content
is owned by or licensed to LilPuma Games and is protected by applicable intellectual property laws.
LilPuma Games and Noah's Ark: Endless Voyage may not be copied, reproduced or used commercially without permission except where permitted by law.
Third-party names, trademarks and services remain the property of their respective owners.
If you voluntarily send LilPuma Games ideas, suggestions, feedback, bug reports or other comments relating to the Game, you grant us permission to use that feedback to improve the Game without an obligation to compensate you.
You retain ownership of any rights you already hold in material you submit.
Please do not submit confidential information or material that you do not have permission to share.
LilPuma Games may release updates from time to time.
Updates may:
add features;
remove features;
change gameplay;
fix bugs;
improve compatibility;
change advertising or purchase systems;
improve security;
address platform requirements;
comply with legal or policy changes.
Some updates may be required for continued use of the Game.
LilPuma Games does not guarantee that older versions will remain supported indefinitely.
We aim to keep Noah's Ark: Endless Voyage available and functioning, but we cannot guarantee uninterrupted access.
The Game or certain features may occasionally be unavailable because of:
maintenance;
technical problems;
platform outages;
third-party service failures;
internet connectivity;
device compatibility;
updates;
legal or regulatory requirements; or
circumstances outside our reasonable control.
LilPuma Games may also stop supporting or distributing the Game in future.
LilPuma Games may restrict access to particular online features or services where reasonably necessary because of:
fraud;
abuse;
security concerns;
serious breaches of these Terms;
unlawful use;
manipulation of online competitive systems; or
requirements imposed by a platform or law.
Because the current Game does not require a LilPuma Games account, there is currently no LilPuma Games player account to suspend or terminate.
You may stop using the Game at any time by uninstalling it.
Noah's Ark: Endless Voyage is provided for entertainment purposes.
We aim to provide a reliable and enjoyable Game, but we cannot promise that the Game will always:
be completely free from bugs or errors;
operate without interruption;
be compatible with every device;
retain every locally stored item of progress in every circumstance; or
have uninterrupted access to third-party services.
To the extent permitted by law, the Game is provided on an "as available" basis.
Nothing in these Terms excludes warranties, guarantees or rights that cannot lawfully be excluded under applicable consumer law.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation; or
any other liability that cannot legally be excluded.
Subject to applicable law, LilPuma Games is not responsible for indirect or unforeseeable losses resulting from your use of the Game.
LilPuma Games is not responsible for losses caused solely by:
third-party platform outages;
loss of locally stored progress following deletion or clearing of app data;
unsupported or modified devices;
internet or network failures outside our control; or
unauthorised modification of the Game.
These limitations do not affect your statutory consumer rights.
Your privacy is important to us.
Our Privacy Policy explains:
what information is stored locally;
how advertising works;
age-related privacy protections;
how Google AdMob may process information;
how consent and privacy choices are handled;
how information may be deleted; and
your applicable privacy rights.

Most gameplay information is stored locally on your device.
You can normally delete locally stored Game information by:
uninstalling Noah's Ark: Endless Voyage; or
clearing the Game's application storage/data through your device settings.

LilPuma Games may update these Terms from time to time.
Changes may be required because of:
new Game features;
changes to third-party services;
updates to purchases or advertising;
legal or regulatory requirements;
platform policy changes; or
changes to the way the Game operates.
When these Terms are updated, the Last Updated date at the top of this page will be revised.
Continued use of the Game after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.
If applicable law requires a different form of notice or consent for a material change, we will follow that requirement.
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the country where you live.
If you are a consumer living elsewhere, you may also benefit from mandatory rights and protections under the laws of your country of residence.
Nothing in these Terms removes those rights where they cannot legally be excluded.
If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
These Terms, together with our Privacy Policy and any other legal notices specifically applicable to the Game, form the agreement between you and LilPuma Games regarding your use of Noah's Ark: Endless Voyage.
They do not override any mandatory rights provided by applicable law or the terms of the platform through which you obtained the Game.
